Informed Consent for Telehealth Services

1. What is Telehealth?
Telehealth involves the use of electronic communications to enable healthcare providers at different locations to share individual patient medical information for the purpose of improving patient care. This may include video consultations, phone calls, and secure messaging between you and your provider through the MDZuri platform.
2. Expected Benefits
- Improved access to healthcare without the need to travel
- More efficient medical evaluation and management
- Access to specialist expertise that may not be available locally
- Convenience and reduced waiting times
- Continuity of care across geographic boundaries
3. Possible Risks
- Delays in medical evaluation and treatment due to technology limitations
- In rare cases, security protocols could fail, causing a breach of privacy
- Information transmitted may not be sufficient for appropriate medical decision-making
- A lack of access to complete medical records may result in adverse drug interactions or allergic reactions
- Your provider may determine that telehealth is not appropriate and recommend an in-person visit
4. Conditions Not Suitable for Telehealth
Telehealth services are not appropriate for medical emergencies or conditions that require immediate in-person examination. The following situations require in-person care:
- Medical emergencies — call your local emergency number immediately
- Active suicidal ideation with intent or plan requiring immediate intervention
- Substance withdrawal requiring medical supervision
- Conditions requiring physical examination, laboratory tests, or imaging
- Severe psychiatric crises requiring inpatient care
5. Confidentiality & Privacy
Your health information is protected under applicable data protection laws, including the Kenya Data Protection Act (2019). MDZuri uses encryption and secure systems to protect your information. However, no electronic system is completely secure, and while we take reasonable precautions, we cannot guarantee absolute security.
Please be aware that SMS and email communications (such as appointment reminders) may not be fully encrypted. Notifications on your device may be visible to others who have access to your phone or computer.
6. Your Rights Under the Kenya Data Protection Act
As a data subject, you have the right to:
- Access — request a copy of the personal data we hold about you
- Correction — request correction of inaccurate or incomplete data
- Deletion — request deletion of your personal data, subject to legal retention requirements
- Objection — object to the processing of your data in certain circumstances
- Data portability — request your data in a commonly used electronic format

7. Cross-Border Data Transfer
MDZuri may process and store your health data using cloud infrastructure located outside of Kenya. Where data is transferred across borders, we ensure appropriate safeguards are in place in accordance with the Kenya Data Protection Act, including data processing agreements and security measures that meet or exceed the standards required by the Office of the Data Protection Commissioner.
8. Health Data Consent
Health information is classified as sensitive personal data under the Kenya Data Protection Act. By accepting this consent, you explicitly authorize MDZuri and its healthcare providers to collect, process, and store your health data for the purposes of:
- Providing telehealth consultations and treatment
- Maintaining your electronic health records
- Facilitating prescriptions and referrals
- Quality improvement and clinical safety
- Compliance with applicable laws and regulations
9. Recording Policy
Video and audio portions of your consultation may be recorded for purposes of treatment, quality improvement, and training. Behavioral health (mental health) visits are not recorded to protect the sensitive nature of these sessions. You may request that your session not be recorded at any time.
10. Right to Withdraw
You have the right to withhold or withdraw your consent to telehealth services at any time, without affecting your right to future care or treatment. You may end a telehealth session at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.
11. Emergency Procedures
Telehealth is not intended for medical emergencies. If you are experiencing a medical emergency, please call your local emergency services immediately. If during a session your provider determines you need emergency care, they may contact emergency services or your designated emergency contact on your behalf.

12. Technical Requirements & Failure Procedures
For the best telehealth experience, you need a device with a camera and microphone (for video visits), a stable internet connection, and a current web browser. If a technical failure occurs during your session:
- Your provider will attempt to reconnect within 5 minutes
- If reconnection fails, the provider will contact you by phone
- If the session cannot continue, it will be rescheduled at no additional cost
13. Limitations on Prescriptions
Your provider may prescribe medications based on their clinical assessment. However, certain controlled substances may not be prescribed via telehealth in accordance with applicable regulations. Prescriptions are not guaranteed for any consultation.
14. Fees, Billing & Cancellation
Consultation fees are displayed before you confirm your appointment. Payment is collected at the time of booking. Cancellation and refund policies are outlined in our Terms of Service. MDZuri is not responsible for data charges incurred on your mobile network during telehealth sessions.
15. Minors and Dependents
If you are booking an appointment for a minor (under 18 years of age) or a dependent, you confirm that you are the parent or legal guardian with the authority to consent to telehealth services on their behalf. You accept responsibility for all information provided and decisions made during the consultation. In accordance with the Kenya Data Protection Act, processing of a child's personal data requires parental consent.
16. Provider Licensing
Healthcare providers on the MDZuri platform are licensed professionals authorized to practice in their respective jurisdictions. Provider credentials are verified before they are permitted to offer services on the platform. You may request to view your provider's credentials at any time.
17. No Guaranteed Results
No specific results can be guaranteed or assured from the use of telehealth services. Your provider will use their best clinical judgment to recommend appropriate care.
18. Your Responsibilities
- Provide accurate and complete health information to your provider
- Ensure you are in a private, well-lit location during video consultations
- Have a stable internet connection or phone signal for the duration of your visit
- Follow up on any recommendations or referrals made by your provider
- Inform your provider of all medications you are currently taking
- Notify your provider if you believe your condition requires in-person care
19. Governing Law & Dispute Resolution
This consent and any disputes arising from your use of MDZuri telehealth services shall be governed by the laws of the Republic of Kenya. Any disputes shall be resolved through mediation or, if necessary, through the courts of Kenya.
20. Consent
By using our telehealth services, you acknowledge that you have read and understood this document. You explicitly consent to receive telehealth services through the MDZuri platform and to the processing of your health data as described above. This consent remains in effect until you withdraw it in writing.
